Terms of Service

These terms govern your use of Foothold Foundry, a marketing operating system for founders. By creating an account you agree to them. This is draft language pending legal review.

1. Your account

You sign in through our identity provider and create your own isolated workspace. You're responsible for activity under your account and for keeping access secure. One signup creates one new workspace; joining an existing workspace is by invitation only.

2. The service

Foothold Foundry helps you define, build, and grow ventures: branding, audience, campaigns, sending, and analysis. Features evolve; we may add, change, or retire capabilities over time.

3. Credits and plans

Paid features are metered in credits, an opaque value unit. Your plan grants a monthly credit allowance that resets each period (use-it-or-lose-it); purchased credit packs persist for their stated life. You always see what an action costs before you spend, and we never charge for work that fails.

4. Billing and cancellation

Subscriptions bill through our payment processor. You can cancel anytime from Settings; cancellation stops the next renewal and you keep your current period's access and granted credits through period end, with no clawback. Purchased packs remain usable for their normal life. Taxes are calculated and collected where required.

5. Acceptable use

You may only send email to recipients you're permitted to contact, and you must honor unsubscribe requests and applicable anti-spam law (including CAN-SPAM). We enforce always-on suppression and a one-click unsubscribe on every send; you may not attempt to circumvent these safeguards.

6. Your data and ours

You own the data you bring (your leads, contacts, and content). We act as a processor for it, described in the Privacy Policy. Notably, your owned data is never sent to an external AI provider.

7. Disclaimers and liability

The service is provided as-is. To the maximum extent permitted by law, we disclaim implied warranties and limit our liability. This section will be finalized by counsel.

8. Changes

We may update these terms; material changes will be notified. Continued use after an update means acceptance.
